Creating Credible Witnesses in Court One of the great worries of litigation is how our witnesses are going to come across. If the Judge and Jury do not believe in them, we're in trouble. Going to Court can be a terrifying experience and this can affect our witnesses in a number of ways: they may be struck dumb; they may go to pieces; they may mumble and mutter and look at the floor - they may do anything, simply because they're scared stiff. There's no logic about this, it just happens. And even barristers, whom we would expect to be hardened cases, can lose their equilibrium if they allow the opposition or the Judge to get to them.
